This Safety / Privacy Policy describes how clubcloudTM collects, stores, uses, and shares Your (clubs and its members) Personal Information when You (clubs and/or its members) visit our site or platform, book an event, sign up for an event, make a purchase, pay for an event, pay membership fees, pay subscription fees, or pay transaction fees.

Despite all reasonable security precautions and processes, such as password protection, encryption technology, and use of firewall technology, no data transmission over the Internet can be guaranteed to be 100% secure.

As a result, while we strive to protect your Personally Identifiable Information, we cannot guarantee or warrant the security of any information you transmit to or from our website, and you do so at your own risk. Once we receive your transmission, we will take commercially reasonable precautions to protect its security on our systems.

If you open a Personal Account with clubcloudTM, your password will be your personal, secret entry code to our website. When you access your account information, it is kept on a secure server and a password is needed to access any account areas.

You can change your password as many times as you like. We recommend that you keep your password in a safe place and that you always sign off your account and close your browser window once you have finished your visit.

These precautions will help prevent someone else from accessing your account, especially if you share a computer with other people or use a computer in a public place such as an Internet cafe or library.

This Safety / Privacy Policy only applies to the way the clubcloudTM, LLC. platform collects and utilizes Your Personal Information – if it collects Your Personal Information at all. It does not apply to any club that utilizes the platform (website and application) as it is the responsibility of each club to implement its own Safety / Privacy procedures and Policy(ies). Neither clubcloudTM, LLC nor any of its holdings assumes responsibly or liability for how each club uses Personal Information.

Please read this Policy carefully as it contains important information about how we use Your personal information on our platform, to provide the products, memberships, and event registrations that You request, improve Your purchasing and registration experience, and communicate with You. By interacting with us in these ways and/or providing Your Personal Information, You agree to this Privacy Policy. If You do not agree, You must not interact with us or see the section on Your Rights below to understand Your alternate choices.

  1. Information We Collect and How We Use It

    We collect information the identifies, describes, or can reasonably be associated with You (“Personal Information”). Personal Information does not include publicly available information or government records or any data that has been deidentified, aggregated, or otherwise anonymized.

    Depending on how You interact with us, we may collect and use Your Personal Information differently.

    • Visiting our Site/Platform

      If You visit the clubcloudTM site or reservation, booking, club management platform, we may use cookies, tags, pixels, and similar tracking technologies (“Cookies”) to support, customize, evaluate, improve, and secure our site and platform. We also use Cookies to understand which items, offerings, and/or products may be of interest to You. These Cookies automatically collect information when You visit the site.     • Joining A Mailing List

      If You join a clubcloudTM mailing list, which is independent of an individual club’s mailing list, through our site or platform, we collect Your email address from You to provide You with information about products or promotional opportunities that may interest You. We do not sell Your email address or provide it to third parties for their direct marketing purposes. You can change how often You receive our email or unsubscribe all together by clicking “Unsubscribe” link at the bottom of any clubcloudTM, LLC., email. If You have a clubcloudTM account, You can unsubscribe though the “Manage Preferences” tab in Your account settings.

    • Making a Purchase or Reservation or Paying a Subscription or Transaction Fee

      1. If You make a purchase or reservation or pay a subscription or transaction fee through the ClubcloudTM site or platform, which is not made through an individual club’s use of the clubcloudTM site or application, we collect the following information:
        • Personal identifiers such as: Your name, Your phone number, Your email address, and Your mailing address;
        • Commercial Information, which includes any and all order histories; and
        • Financial Information, including Your payment method and billing address. We collect credit card payments from users when making a purchase. No payments are collected without a user’s explicit authorization. All credit card information is processed for us by a third-party merchant processing service, and we do not have access to any of our users’ personal credit card information. Processing of all credit cards follows credit card industry standards. As always, consumers making purchases must have a valid credit card and have a good credit standing. Unless the user/consumer directs their individual club in writing to issue a refund through an alternative method, all refunds shall be made to the user’s/consumer’s credit card that was used to make the purchase or payment, whether or not that card has been cancelled or replaced. In most cases, the user’s/consumer’s issuing bank will not accept a refund to a cancelled card; however, in some instances, refunds to a cancelled card are accepted by an issuing bank. If that occurs, the user/consumer agrees to hold their individual club and ClubcloudTM, LLC., harmless for the amount of that refund or any concomitant damages.
        • We use Stripe for processing of payment, analytics, and other business services. You can learn more about the Stripe Privacy Policy ,

          • We use this information to complete Your purchase or reservation and, if You opt in to receiving ClubcloudTM emails, to provide You information about exclusive offers and products based upon Your past purchase history and the items that You considered purchasing or have saved in Your cart.
      2. If You make a purchase or reservation through an individual club’s white-labeled use of the clubcloudTM site or application, ClubcloudTM does not own Your data, and has only the limited administrative control over that data that Your individual club permits. In that case, it is Your club’s responsibility to protect Your data. Please refer to Your individual club’s Safety / Privacy policy.
      3. We use the Odoo Enterprise Resource Planning platform for some of our ERP functions. You can learn more about the Odoo Privacy Policy ,

    • Contacting Customer Services and/or Customer Support

      If You contact Customer Services and/or Customer Support for questions, technical support, comments, or feedback, we may collect the following Personal Information:

      • Personal identifiers such as: Your name, Your phone number, Your contact information, Your email address, Your phone number, and Your mailing address;
      • Commercial Information, including any order, business, or maintenance history;
      • Audio or video recordings if You call us or send us video content;
      • Your comments or other details about Your request to Customer Services and/ or Customer Support.

      We use this information to respond to Your request for Customer Support. We take your comments and feedback seriously, so we may also learn from this information to improve our quality assurance and for training purposes.

    • Interacting with us on Social Media

      If you follow or friend us on any social media networking platforms, such as Twitter, Facebook, Instagram, and Pinterest, both ClubcloudTM and/or the social media platform ma collect Personal Information about you, including:

      • Personal identifiers such as: Your name, Your phone number, Your contact information, Your email address, Your phone number, and Your mailing address;
      • Personal Identifiers, such as the username or handle you use for that social media platform;
      • Content that you share or post on ClubcloudTM pages or threads; and
      • Depending on your privacy settings, your contacts, followers, or friends on that social media platform.
      • We use the information that we receive through social medial platforms to enhance our social media presence, improve our products, and deliver relevant information about promotional opportunities, marketing materials, or other incentives. We do not control and are not responsible for how social media platforms use the information they may collect about you when you use social media. Instead, you should look to the social medal platform’s privacy policy and terms to understand their practices or control choices.

  2. Cookie Policy

    Our site(s) and platform use cookies, tags, pixels, and similar tracking technologies (“Cookies”). A Cookie is a small piece of a text file that is places on your website browser when you visit a website. These include our own first-party Cookies and third-party Cookies of our service providers and marketing partners. Some Cookies are only stored temporarily and are destroyed each time you close the web browser (“Session Cookies”). Our site also uses “Persistent Cookies,” which do not delete when you close your browser and may collect our platform data for a set period of time after you have left our site or platform.     • Do Not Track

      Some website browsers enable “Do Not Track” requests to block your activity from being tracked across web pages and devices. Our site does not recognize Do Not Track signals as there is no industry standard way to do so effectively.

  3. When and Why We May Disclose Your Information

    ClubcloudTM may at times work with venders and service providers to make our website and platform function, improve our offerings, and run our day-to-day operations.

    • Disclosures to Provide Services You Request and Support Operations

      • Service Providers:

        We rely on vendors, professionals, and technical support providers to help us operate the site and platform and with our business by doing things like designing the website, processing your payments through Stripe, and supporting our customer services and technical support;:

      • Marketing Partners:

        We rely on other vendors to help us place ads, customize them to certain audiences or users, understand whether those ads are successful, and improve our marketing efforts.

      • With Your Permission:

        Under some circumstances, we may ask you for your permission to share your Personal Information with third parties outside the scope of this Privacy / Security Policy.

      • Public Communication:

        We may allow you to make public comments on our website in the form of reviews and other comments. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

    • Disclosures Required or Permitted by Law.

      We will disclose Personally Identifiable Information, after subpoena or written request, to cooperate with a law enforcement investigation. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

      We do not voluntarily disclose user personal information to unaffiliated third parties. If we are served with a subpoena for personal information of a user, we will provide notice to the user whose personal information is sought by the subpoena to give them the opportunity to object to the subpoena. If the user does not object to the subpoena within a specified period of time, we will comply with the terms of the subpoena. Should the user object to the subpoena in a court of law, we will abide by whatever decision is reached by such court of law.

      Nothing in this Privacy / Security Policy restricts ClubcloudTM, LLC., from disclosing Personal Information to:

      • Prevent, investigate, or provide notice of fraud, unlawful or criminal activity, or unauthorized access to or use of Personal Information, our website, platform, or data systems;
      • Collect, use, or share aggregate de-identified data;
      • Comply with federal, state, or local laws;
      • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;
      • Cooperate with law enforcement agencies concerning conduct or activity we, our service providers, or third parties reasonably and in good faith believes may violate federal, state, or local law;
      • Exercise our rights or defend ourselves against legal actions; or
      • Transfer Personal Information as part of an actual or proposed organizational transaction, such as a merger, acquisition, or dissolution, or if insolvency occurs, bankruptcy or receivership.
  4. Your Rights

    You have the option to control when and how your Personal Information is used for purposes not directly related to placement, processing, fulfillment, or delivery of the product or services that you purchase.

    • Unsubscribe from Emails

      You can change how often you receive our emails or unsubscribe all together by clicking the “Unsubscribe” link at the bottom of any ClubcloudTM email, or if you have an account, through the “Manage Preferences” tab in your account settings.

    • Reviewing, Changing, Updating or Opting Out of Your Account Information

      You can review your account information and manage preferences any time by logging into your ClubcloudTM account. You can also update or change your password, address, and payment information at any time.

      If you would like to modify your account simply return to our website, click on the link called “Your Account”. Once you have signed into your account a menu of options is provided for you to delete or edit your stored account information.

      Unfortunately, to the extent that such information is also stored in other databases, we cannot always ensure that such corrections or deletions will reach the other databases. We will use all reasonable efforts to ensure that your information is removed from or corrected in our records.

  5. California Residents’ Privacy Rights

    For our clients and customers who are California residents, you may have additional rights over Personal Information. If you are not a California Resident, this section does not apply to you.

    1. The Right to Request More Information

      You may have the right to request more information about how we treated your Personal Information in the past twelve (12) months, including:

      • The categories of Personal Information we collected about you;
      • The categories of sources from which we collected this information;
      • Our business or commercial purpose for collecting that information; and
      • The specific pieces of Personal Information we collected about you.
    2. The Right to Request Access

      You also may have the right to request access to your Personal Information.

    3. The Right to Request Deletion

      Under certain conditions, you may have the right to request that we delete your Personal Information. Simply logging out of your account does not delete your account or Personal Information we may have collected.

    4. How to Exercise these Rights

      To submit request to exercise these rights you may contact us at info@clubcloud.com For all requests, please clearly state that your request is related to “Your California Privacy Rights” and provide your name, street address, city state, zip code and an email address and phone number where you may be contacted. If you make a request, we will acknowledge we have received it within ten (10) days, and we have forty-five (45) days to respond to you.

    5. Verification

      Before we can respond to your request, we must verify your identity using Personal Information. If we cannot verify your request, we will contact you for more information. If we cannot verify our identity after a good faith attempt, we may deny the request, and if so, we will explain the basis for denial.

    6. Designating an Authorized Agent

      You may designate someone to submit requests and act on your behalf (an “Authorized Agent”). To do so, you must provide us with written permission to allow your Authorized Agent to act on your behalf.

    7. Do Not Track Requests

      As described above, we use Cookies to collect information about your internet activity to help us provide you with relevant advertisements, incentives, or offers. Some web browsers or smartphones can be set to “Do Not Track” to block user activity from being tracked across web pages or devices. Our site and platform do not recognize “Do Not Track” signals.

    8. Third-Party Marketing and Selling

      We may provide your information to third parties for their direct marketing purposes. We may also collect your unique online identifiers, Internet Protocol address, browsing history, search history, and information about how you interact with our website. We may disclose this information with a third-party marketing company, social medial platform, or analytics partners that support our online marketing efforts, deliver meaningful ads to you, connect with social media networking, and help us improve the use of our website and services. Under California Law, you have the right to opt-out from these disclosures of Personal Information considered to be a “sale” as defined in the CCPA.

    9. No Discrimination

      We will not unlawfully discriminate against you for exercising your rights.

  6. Third-Party Links and Sites

    Our site and platform may contain links to other websites. These websites may have different privacy and security policies from ClubcloudTM. A link to a third-party’s website does not mean we endorse it or that we are affiliated with it. We do not exercise control over third-party websites, so we are not responsible for how they treat our Personal Information. We urge you to follow safe Internet practices and not to supply Personal Information to these websites before verifying their security and privacy policies.

  7. Children’s Policy

    The ClubcloudTM site and platform are intended for users who are eighteen-(18)-years-old or older. We do not knowingly collect Personal Information from children under the age of thirteen (13). If we learn that we have inadvertently received Personal Information from a child under the age of thirteen (13), we will delete such information from our records.     We may update this Policy from time to time. The date this version of the Policy was updated is posted as the “Effective Date” above. If we make any material changes to this Policy, we will take reasonable steps to notify you.
